Evection Question.

We are being evicted. I live in an apartment that is based on income. I believe it is called subsidized housing. We are going to be evicted because of damages. My son is bipolar and has a bathroom problem. Anyway, they have not filed yet, but they are going to. My question is this; ''I I pay my rent this month, and then they file for me to be out in 10 days. Do I have the full month to find another place, or once they file do I have to be out in 10 days?'' ''What are my rights''

You are not evicted until the judge says you are evicted. Do not move out just because they send you a letter telling you to move out. That would be breaking the lease. If you do not move out as requested by their letter, they have to file an eviction suit in justice court, you will be served with papers which will tell you when your court date is. It will be pretty soon, no later than ten days away. Even if you lose in court, you still have five days to either appeal or move out. You should pay your rent because that will be another ground to evict you and there is no defense to nonpayment of rent. You should call North Texas Legal Services for representation if they do file eviction.
