Legal Question in Landlord & Tenant Law in Texas

Eviction Lawsuit

I am being sued for non payment of rent and lease violation. The rent was refused by the landlord on March 31st and was not due until April 1st. we received a 3 day notice to vacate on the 31st stating we were in violation of the lease agreement, because we had othe roccupants in the house. My daughter and granddaughter were visiting for the weekend. Since that time we were harrassed on several occasions and the law was called. It was suggested that we just move rather than to have any more problems, so we moved. The house was left in perfect conditon other than damages the landlord did himself by running a mower into the side of the house to intimidate us. We have a six month lease and put up a five hundred dollar deposit. I would like to know what legal recoure we have in this matter and weather or not we should counter sue or just show up in court with the evidence we have.

Re: Eviction Lawsuit

It sounds like there is more to this problem than outlined in your question. If you are absolutely sure your landlord is in the wrong, you can file a countersuit. Keep in mind there may be a filing fee for this and you may lose. Be sure you show up for the hearing, and be prepared (with documentation and/or witnesses) to present your case, because your landlord will win by default judgment if you don't. It sounds like you are trying to recover your $500 deposit and it would cost you more than that to hire a lawyer. Good luck.
