Eviction

I moved into this property on 9-1-07 with a rent to own agreement with $4000.00 down. I have been late the last two months but have paid the total rent and the late fees within 10 days both times. I got an eviction notice the first time and they looked past it. I have now gotten a second eviction notice today 10-16 and they are saying I need to be out by the 19th. Is this right? I know it is a little different since we put a lot of money down and we have paid. It is not a non-payment case. In the lease it says the late fees would be 25 dollars plus 5 dollars a day but no mention of eviction. I have left a note and called the landlord 7 times and have left two voicemail messages. The eviction notice said we could contact them to work something out but they have not answered thier phones all day nor returned my phone calls. I have a son and fiance to worry about I can't be homeless. They are being heartless. And like I said I have paid the required fees and rent it is not for NON PAYMENT. Please help if I need to move I need to know.

If its a rent to own, then they have to give a 60 days notice and give you an opportunity to cure. Take your agreement with you to court and show the judge.
