eviction procedure
I owe $834 for rent and late fees to my apartment complex for the month on October. On September 24th, I went on short term disability from my work. The checks from the insurance company have not come in yet and when I explained the issue to my apartment manager, they filed for eviction. I have three days to vacate. My question is....can they legally evict me though I have a medical condition preventing me from working and have the money to pay them coming??? Is there anything I can do to keep them from forcing me to move out???

Get out your lease -- what are the terms for which they claim they can initiate eviction. If you are able to pay rent timely, and abide by the terms of the lease, you should be okay. The ADA will protect you in JP court on the eviction, but will not excuse your inability to pay the rent. Start preparing your documentation for the court.
