''friend'' will not leave house
I have an aquaintance who was in need of a place to stay two months ago. I let him stay in my house with the understanding that it would be for at most one month. A couple of weeks ago he began to recieve mail at my house, and when I asked him to either pay rent or move out, he told me it was his right to legally stay here as we had an oral agreement and that he was a tenant. I asked him to move immediately and he refused, telling me I needed to move out. My house is in probate due to my partner dying, who left it to me. My friend knows this, and he also knows I am the executor of the estate. Yes, I realize this sounds like a childish squabble, but I cannot get him to move out. This is a big problem because I may need to sell the house within the next month to cover debts owed by the estate, and the room he is staying in is in total chaos.You can hardly walk through the room, which is a converted garage - the largest room in the house. What legal means are at my disposal to get him out quickly?

Give "friend" a three day notice to vacate. When three days is up, file an eviction lawsuit.
