Legal Question in Landlord & Tenant Law in Texas

holding property for money owed

I recently moved out of a friends apartment. I did not pay rent and was not on the lease. I attempted to get my leather couches back and was told that once I paid him the money I previously owed him, then he would give me my furniture back. There was no contract and we did not agree on him holding my couches for collateral. Can he legally keep my couches since I owe him money? If not, is there a formal way to get my couches back or how do i go about doing so?

Re: holding property for money owed

You can sue him for the value of the couches in JP court. The judge will determine if there is a debt owed between you, and rule accordingly.
