Legal Question in Landlord & Tenant Law in Texas
judgment
I got a judgment for $280.00 for an
eviction. The judgment is listed on
my credit report, however, the
apartment complex has also listed a
balance owing of $3,112.20 on my
credit report for some other
damages, i.e. not returning key, torn
carpet, water bill, and pet violation.
Shouldn't that have been included in
original suit and thus made part of
the judgment?

Re: judgment
Short answer, no. All that is at issue in an eviction is who has superior right to possession of the property. Landlord may recover rent, attorney fees (if they use an attorney) and court costs. Other damages can't even be calculated until you move out and then your security deposit is applied. So, no, those other damages weren't incurred until after you moved out and the landlord couldn't, even if he wanted to, include them in the eviction.
