Legal Question in Landlord & Tenant Law in Texas

Landlord asks for higher rate

In my apartment lease, it says if I want to move out, I have to give a written notice 45 days before the end of the contract. 2 days before the contract ended, the manager gave me a new lease with much higher rent! I was so upset and wanted to move out. She said if I moved out, I would break the lease term because I didn't give her 45-day ahead notice! The fact is I didn't want to move out! It's because she asked for higher rate I couldn't affort! She said she had sent me a letter about the higher rate 45 days before the end of the contract. She lied! I never received such mail. Am I breaking the contract if I move out? Actually, 2 days are not enough time for me to move out, do I have right to stay for 30 days more at the same rate to complete my moving-out because she gave me a new term with much higher rate just 2 days before my contract ends. Please help. Thanks.

Re: Landlord asks for higher rate

Read your old lease -- there will be provisions for a month-to-month tenancy. GENERALLY speaking, you will be a hold over tenant. Pay the next months rent, with a CMRRR notice that you are vacating in 30 days -- due to the increase in rent, with no notice to you.
