Legal Question in Landlord & Tenant Law in Texas
Landlord will not give a rent deduction
We have asked our landlord since approximately November of 2005 to come and look at the house we detect some foundation problems. It took her 4 to 6 months to come out and look at it. We have asked her for a rent deduction due to the living conditions and they are getting worse by the day. Four different contractors have came out and looked at it and two of them refuse to repair because they don't want to be liable. She only wants to patch up the cracks not repair the foundation which it is in serious need of. She is not the owner she is leasing the property for him and I'm sure that he would not want the house to go down like this. What can we do or what should we do?

Re: Landlord will not give a rent deduction
Before any rights attach, you have to give notice in writing, CMRRR. You may not be entitled to a rent reduction -- there are specific procedures to follow, and it only applies in some circumstances, primarily in dangerous situations. You can access further information on this issue at the Texas Attorney General's website, (under consumer - landlord-tenant issues) as well as the Texas Property Code.
