landlord/tenant question

I have a rent to own tenant in my home......21 months ago, they agreed to pay off the equity AND get their own financing. To date, this is still not done. On 04/03/2007, I gave written notice of eviction, to vacate......after I had given them written notice on 02/03/2007 to get their financing or try to sell the house or the house became a rental property.........which did not happen..... I have hired a Bexar county deputy to go to the house on 05/03/2007 to enforce the eviction. Am I within my legal rights and have I covered all the bases???? Please respond asap...as the 3rd is fast approaching.....(their payment was made up until 04/30/2007

Generally, to evict someone in Texas you need a court order. Usually this is done by filing a forceable entry and detainer action in a justice court with jurisdiction over the property.
