Legal Question in Landlord & Tenant Law in Texas
Legal Liability
My boyfriend and I went to look at house. The landlord had two couples meet there at the same time. He asked me if we wanted the house, and we told him yes, and wrote a post dates check for the following friday. Well during the week there were some issues that came up and we decided that we did not want to rent the house. We called the landlord, and there was no answer, so texted him to have it in writing to let him know that we did not wish to rent the house any longer, and I appologized for any problems. We called the bank and put a stop payment on the check. I sent the text on thursday the day before the check was post dated for. Now he calls and leaves threatening messages, and stated that he was going to cash the check. He wants us to pay $300.00 for the house, and wants to go to court. Does he have legal ground to sue us for the $300 dollars.

Re: Legal Liability
Maybe -- if he took the house off of the market and can show he was damaged by that, based upon your first assurance that you would take the house, then he may be able to show that he is entitled to be compensated.
If the other couple was ready, willing and able to take the house, and then later was not, then he could have a good case.
Try to negotiate this with him.
