Legal Question in Landlord & Tenant Law in Texas

re: I can't live here any longer

Hi,

It's me again. I went ahead and send the letter like stated in your reply. I was just wondering if the manager does not fix the repairs in my apartment and I move after the 7 days are over will she be able to put it in my credit as a broken lease? Or what can I do about that? Will I be able to sue her if she does?

Once the seven days are up with no repairs, send another letter stating that due to the landlord's failure to comply with the property code you are terminating the lease according to the law. Send them notice of your new address, take good pictures before you move out to prove you left it in good condition. They will send you a security deposit accounting claiming that you have broken the lease. That is when you want to hire an attorney to file suit. Even though you have done everything by the book, I have never seen a landlord honor a lawfully terminated lease.
