Legal Question in Landlord & Tenant Law in Texas
I can't live here any longer.
I moved in to these apartments 2 months ago. The apartment was supose to be ready the 1st of September and it ended up being ready on the 5th. I had signed all the papers to move in,but when I moved in to the apartment the carpet was filthy and black stains everywhere. I contacted the manager that same day and she stated that someone was going to clean it within a week. I waited that whole week and no one came so I took pictures of everything that was wrong with the apartment and I went to see the manager and showed her pictures of how dirty the carpet was and I told her that the carpet needed to be replaced she agreed and said someone will change my carpet in a couple of weeks I've waited and noticed that their is a lot of ants in this apartment that have been biting my daughter. I even rented a machine to clean the carpet with no sucess in cleaning because it's extremly dirty. I told the manager to change me to a diffrent apartment, but she said no. What can I do? If I break my lease becuse of this will it affect my credit? Or no because their not keeping up with what their agreements were?

You need to send a written request to the landlord, certified mail, return receipt requested, listing all the repairs that need to be made. Under the property code, 7 days is considered to be a reasonable time for repairs to be made. If they are not, you can terminate the lease.
