Legal Question in Landlord & Tenant Law in Texas
Hi I live in Texas and signed a one year lease to rent my apt on march 31, 2011 for one year.march 1 of 2012 I had to ask Mgmt fo renewal lease as I had not received any communication. Two weeks later I got a letter simply stating renewal rate would increase rent $10and month to month would increase rent $100. I verbally asked for renewal lease to review terms but never got it. It is now June I've been paying the increased rate but never got a renewal lease. Am I in a new lease or can I give a 30 day notice and move out?

If you paid the additional $100 per month, you are renting under the holdover provision in your old lease.
If you are paying an additional $10 per month, they can argue that their letter was an offer and your continuing to pay the cheaper rent was an acceptance binding you to the terms of a one year lease.
