Legal Question in Landlord & Tenant Law in Texas
If I am on a month to month basis with my apartment and have no lease , can they still charge me late fees on rent even though I am paying them. I told them it would be late b ut they are charging me over $700 in late fees. Is this correct or do I have something I can do to lower the fees if I have to pay them.

I think you're saying that you have no WRITTEN lease. If you're living somewhere and paying money for it, you DO have a lease.
The only question is: What are the TERMS of the lease?
Your remedy is simply to move out.
Another remedy is to insist on a written lease, since it's obvious that the specific terms of your lease are in dispute (since it's an oral contract).
