My hsband and I got a letter in the mail statng his cedit could not be granted at this time.Well we have not filed for any credit to refinace our home.The compay told me it was done in June of 2002 and it was done over the phone.Well I do belive that we would remember if we where trying to refinance,and we just found out that the compnay took it upon themselves to recheck the credit in Oct.2003 with out calling us to get permission or letting us know that they are doing it.Right now we are in the process of getting a credit report to see if someone has been using my husbands credit.The company also told me that they have no way of finding out who it was that submited the information over the phone and they did not record the conversation.
My question is,is it legal for a company to take it upon themselves and check your credit again without your permission over a year later?

An existing creditor, a creditor with whom you currently have an account or are doing business with, can periodically check your credit. If you have never done business with this company, however, then they must have your permission to check your credit.
