Legal Question in Landlord & Tenant Law in Texas
Move-out Question
We recently moved out of our apartment. When we moved out, the leasing agent stated the apartment was the cleanest she has ever seen, this was on 11/17/03. We received a letter 1-5-04. The letter is dated 12-16-03, but postdated on the envelope for 12-23-03. In the letter, it stated replaced carpet - $500. Later, they said it was for pet damages, but we don't have a pet and their charging us full price for new carpet when it was old when we moved in. Here is my Question: If the Landlord gets thirty days to post damages, is the 30 days based on the date on their letter or on the postdate from the mail envelope.

Take them to small claims court. You are eligible for treble damages. Best of luck.
