Legal Question in Landlord & Tenant Law in Texas
I am moving my 85 year old mother from San Antonio up to the DFW area to be near me due to her dementia getting worse. She currently lives in an apartment community for seniors and has a 1 year lease which does not expire for a few more months. I need to move her up here within the next month. I was told by the apartment manager that in addition to the 30 day notice I would also need to pay a reletting fee of 85% of one month's rent. I guess I assumed that due to the circumstances and the fact that she is moving out of the city that there wouldn't be any reletting fees. I do not have a copy of her lease but just wanted to know if they can charge a reletting fee for a situation like this. Thank you.

I believe this depends upon the lease she signed. However, if your mother signed the lease when she had dementia the lease contract may not be binding.
