Legal Question in Landlord & Tenant Law in Texas
Notice of Acceleration of Rent
Today we received a ''Notice of Acceleration of Rent'' saying that ''we or an agent gave notice of intent to move out prior to your lease date...'' Our lease is up in 5 months & we are required to give two months notice. As this is a college town, rental properties go quickly & you have to begin your search early since many landlords know months in advance if their residents are moving out or not. We were interested in leasing with a lady who said she had 7 properties all available for lease w/in the next few months. She called our current landlord to verify our residency. The manager of the property service said she could not give out any information on us unless we gave notice to move. But we don't want to give notice since we have no where to move to and it is not time. Then we receive this letter the same day saying ''our agent'' called and said we had intent to move out prior to the end of the lease? That is not true! She wouldn't give our rental history to the woman who called since we hadn't given notice to vacate, yet she took the lady's call as notice? Isn't that contradictory? Also, we have a right to inquire into other places & explore our options without necessarily meaning we intend to move out. What can we do?
