Legal Question in Landlord & Tenant Law in Texas
I put a deposit down on a rental home yesterday in the amount of $1195 in the form of a Cashier's check. I have not signed the lease yet, but woke up this morning with a change of mind on the home. I contacted the landlord and advised him of my decision. He is refusing to return my deposit. Does he have this right if I have NOT signed the lease agreement?

You should get your money back.
Write him a letter - paper letter - no phone calls or emails - tell him what you told me - demand your money back, and give him a deadline (ten days from the date of the letter). After the deadline is up, sue him in Justice Court (filing fee will be about $100).
