Question on breaking a lease

Hello,

I have a question on my leasing at my apartment complex. I had signed a 12months lease but am looking to move out early (10months early). But when I ask if I could just cancel my contract and just pay the contract fee, they said that I would have to pay the remaining 10months plus a 85% fee, that means I have to pay $575x10+$475.59= $6,225.59(It's outrageous!). Can they do that?

Why should they let you break the lease with no consequences? Under Texas law, if you break a lease, you are responsible for a re-letting fee, and rent until the apartment is re-let. The landlord does have a duty to try to re-let the apartment. You should not have to pay the entire lease up front, but as each month comes up and it has not been leased, you will owe the rent for that month. You signed a contract agreeing to pay rent for 12 months.
