Legal Question in Landlord & Tenant Law in Texas

I want my roommate gone.

I moved into a 3 bedroom apartment with two other girls in August of 2006. Girl A is fine, she and I get along. Girl B is a walking nightmare. Both Girl A and I are at our wits end with what to do about her. The complex won't help us, and because we have individual leases (per bedroom) we have no legal right from what we can tell to get rid of her. She has broken items of ours, stolen dishes, and has a total disgregard for the communal areas in general. She never locks the door when she leaves, the electric bill is really high because she doesn't turn off any lights or her television when leaving the apartment. She has a cat that she won't care for, his litter box hasn't been changed in over a month, when Girl A and I moved the litter box from our laundry room to her bathroom, but the smell is so bad from even there that the entire upstairs stinks. We have tried talking to the complex administration, but they say they can't do anything about it. We've talked to her parents, but she's 21 and they say they can't do anything either. PLEASE HELP ME. Girl A and I have gone through emotional distress because of this horrid living situation. Mental and physical suffering has resulted, and school is due to start in 2 weeks.

You have tried every avenue to get rid of Girl B and have learned that you cannot. It appears that your only alternative is to go to the apartments and negotiate a termination of your leases, and you two girls move out. You might want to read your leases to see if there are any provisions regarding a habitable environment. I would suggest that a filthy litter box spreads contamination and germs harmful to humans -- but that is only a guess.
