Security Deposit

Hello,

I moved out of my apartment with written 30 day notice, my last day there was April 30th, 2007. I have yet to receive my $400 deposit back or a letter of explanation as to what damages were assessed. The property is being managed my a realty company and I have called numerous times and left messages for the property manager, the one time I was able to speak with him, (at least 3 wks ago) he said he would call me the next day. I still have yet to receive any notice or refund & it's been 104 days since I left my apartment. What can I do to stop being ignored and get the ball rolling? I'm very aggravated and at this point I fear that they will create reasons not to give me back my deposit. What can I do? Should I file a claim in small claims? And, would I sue the property owner or property management group?

Assuming you have provided a forwarding address, your landlord has 30 days from your move to return your security deposit. Send a certified letter, advising that if you do not receive the security deposit in 30 days, you will file suit against for return of the security deposit plus damaages.

This should motivate them to return the money.
