Legal Question in Landlord & Tenant Law in Texas

'' We might let you stay if...''

This past month has been tough. I owe my apt.'s $626.00 for this months rent. They have already filed eviction and I called them today asking if there is anyway to stop the eviction since things are settling down and I have all the $$ ready to give them. I was told that my sister( who stays here 2-3 times a week since she works late nights and my family lives 40 miles away) would have to fill out an application and go through that entire process. Well she is not a resident here and we were not planning on making it that way. Also, she is living with my parents so she can get herself back on her feet and we are about 95% sure that her credit won't be approved. So are they going to proceed with the eviction after I pay rent b/c of my sister. What if my sister doesn't stay the night anymore, will & can they just create new standards and boundaries. I am very confused on what to do? Please help. What is the legal side of this mess?

When you go into the manager's office, ask them for something in writing that indicates that the eviction is dropped. If they refuse, then you may tell them that there is no need to evict you, that you will pack and move within the next few days, and use that money for rent and deposit on a new apartment. (You don't want an eviction on your record, as someone else won't rent to you). Your lease indicates how often a person can stay in your apartment and be considered a guest, not a resident. If your sister falls within those guidelines, then refuse to have her sign up. If she DOES fall within those guidelines, then you may want to consider moving anyway. Good luck to you. TCL
