Legal Question in Landlord & Tenant Law in Texas
Tenant
My landlord sent me a letter to vacate my home in 3 days or he was going to change the locks. The letter it self has no state stamp or noterized. There was no written lease made or signed, but I do have receipts of rental payments. Can he lock me out? I have not received an eviction notice either. What do you recommend I should do?
Thank you

Re: Tenant
If he wants to evict you for nonpayment of rent, he must give you a three day notice to vacate. If he just wants to evict because he wans to evict you, since there is no lease, you are on a month to month basis and he must give you thirty days written notice. To change the locks, he must give you five days advance notice. When he changes the locks he must leave a notice telling you where you can get a key 24/7 and he cannot require rent to be paid as a condition. So, he really cannot lock you out. If he does, go directly to the Justice of the Peace court and file a writ of re-entry. If he violates these requirements, you have causes of action against him under the property code.
