Legal Question in Landlord & Tenant Law in Texas
Tenant rights--please help!
Landlord claims I abandoned my apartment. I did not. Electricity& cable still connected. My cat w/ fresh litter, food& water still there. No property had been removed. I was late on April rent but she says I was 4 months late. Little history--on Feb 5 we went to court on eviction. Said I owed $1607. Judge ruled I only owed &587. It was paid. Fast forward to April. On 4/9 She left ''Notice for Intent to File Eviction''on 4/13 if rent not paid by 4/12 (Easter Sunday--office closed all weekend). Instead she claims to have left ''Notice of Abandonment'' on my door on 4/13. She did not. While I was at my mom's on 4/16 she(&others) entered my apt &disposed of all but some clothing, paperwk (emptied plastic bins & took them), pictures (took them out of frames & took frames), & my cat. They took everything else. All furniture, bedding, toothpaste, hair dryers, shampoos, perfumes, towels, you name it. Even items belonging to deceased uncle and grandma (crosses) & my public library books. Made no attempt to contact me. A neighbor called me. By the time I got there, she said it was all put in dumpster & hauled away. Refuses to give me copy of abandomt letter, itemized list of my property or pics, or contact to corporate office. Is this legal?

Re: Tenant rights--please help!
First, you say you were late on April rent, but do not explain if you paid all of April and April late charges.
Secondly, she evicted you without a court order. You need to file suit against her. In most cases, you would be entitled to recoup your attorney fees and damages.
