Legal Question in Landlord & Tenant Law in Texas

Can I terminate lease due to flooding entry walkway?

The walkway and porch leading to our apartment floods at least 3''every time it rains or even sprinkles. The ground is always saturated from a leaky sprinkler system. What are our rights as renters? What can be done? We are currently receiving a military discount of $80 off our monthly rent.

We were told that if we broke the lease for any reason other than military purposes that we would have to pay back that $80 for each month we lived here. If we break our lease due to the water issue are we still responsible

for paying?

Your recourse is small claims court. Tell your story to the judge and you may receive a judgment for damages. Don't break your lease or withhold rent as an offset. That would work against you. Good luck.
