Legal Question in Landlord & Tenant Law in Texas
I'm thinking of buying a house as rental property that has an in-ground pool in a fenced in backyard. Do I as landlord have any additional liability due to the pool and how can I protect myself from this liability. Will a release of liability attached to the lease be of use? Will my homeowner's policy protect me?

Yes, you have the potential for extra liability from those outside the renters (who may come onto the property without invitation.) It is called attractive nuisance. Talk with your insurance company about the insurance needs. Also, when you rent the property, make sure that your rental agreement has a special acknowledgement about the pool and potential issues. If there is no special fees around the pool itself, include that specific detail in the lease.
