Legal Question in Landlord & Tenant Law in Texas

unsafe living environment

After both my girlfriend�s car as well as my own had been broken into we decided not to renew our lease at the end of our agreement term. Now we have not reached that date yet but after my girlfriend was brutally assaulted and robbed I am ready to leave. I need to know if there are any loop holes in a standard TAA agreement that will allow us to leave.

We no long feel safe and need help. Thank you

The law provides an automatic 'out' in the case of family violence, but not random violence. There is a requirement that the landlord provide security, and not be negligent. The issue becomes whether the landlord was negligent in some way about providing minimal security -- or the amount out security which was advertised. There is caselaw that has upheld a tenant's claim for damages based upon the landlord's negligence. If that is true here, it would certainly outweigh any loss on the lease. Talk to an attorney in your area familiar with premises-liability law.
