Legal Question in Landlord & Tenant Law in Texas
Getting out of my one year apartment lease
Hi, I have lived in my one bedroom apartment for one month now. 1.) I am not a smoker and smokers lived in the apartment before me. Therefore the apt has a dreaded smell of cigarette smoke. It's so bad all of my clothes reek of the smell. The apt complex treated the apt with an ozone treatment but it still smells bad. 2.) The carpet was not changed out because per the apt complex its not worn out however it disgustingly dirty. If I'm dancing or walking back and forth in my bare feet they get dirty. They get black dirty as if I were walking bare foot outside in the dirt. I have to wash my feet before I go to bed. Well not any more because I no longer walk bare footed in my apt. How can I get out of my lease. I dont think I can live in an apt this dirty for the next 11 months. Please Help! And I do have pictures of how worn out the carpet. Thank you. RG

Re: Getting out of my one year apartment lease
You can try to negotiate out with the landlord, but I would not expect a good response. If they do let you out, get the terms in writing.
You inspected the property, and accepted it, and leased it, so you are probably stuck. See if they are willing to repaint, and to shampoo the carpet.
