Legal Question in Landlord & Tenant Law in Texas
Yesterday, I arrived at home to find my apartment was filled with what turned out to be gasoline fumes. I called the property manager and told her what was happening, and that I was sure that the gas fumes were flammable, and that it was coming from the garage that shares a wall with my apartment. The manager waffled about having someone come to open the garage and allow it to ventilate. I ended up calling the Dallas fire department. The firemen confirmed that this was gasoline, and also stated that this was definitely a dangerous situation. The garage was saturated with gasoline fumes, and it could have caused a fire, or explosion. The property manager refused to handle the situation. Is this something that I can sue for?

This is called a violation of the warranty of habitability, and it is grounds for termination of your lease (that is, you can move out). It probably wouldn't be worth it to file a lawsuit.
