Legal Question in Legal Ethics in Texas
civil settlement
Recently I was issued a check (personal) from my attorney regarding a MVA settlement. I explained to the attorney that I did not have a valid id card to cash this check when the lawsuit began (2-3) months ago and he assured me that it was no problem, that he could just make it out to my father or girlfriend. After the check from the insurance company arrived and my attorney got his ''cut'' he wrote me a personal check which I can not cash. I must now wait a month for my birth cert. and then my ss card and then an id. Why is there no way for him to make out the check to someone else? I told him I will sign any paperwork or even give someone else power of attorney. It seems like he just wanted to make his money and now I am screwed. Is there anything legally that I can do to get the check made out to someone else.

Yes the attorney should help you get your money faster. You can tell them you're considering complaining to the bar if they don't go to their bank with you and get the money for you.
