Legal Question in Legal Ethics in Texas

I filed a complaint against an attorney with the State Bar Office of the Chief Disciplinary Counsel; the attorney took my money ($2500.00) under false pretenses. The investigator concluded there was professional misconduct on behalf of the attorney.

I received a letter from the Disciplinary Counsel stating the attorney did not elect to have the matter tried in district court; the complaint with be heard by an Evidentiary Panel of the District Grievance Committee.

I also read on the State Bar website that the grievance system cannot award damages. Can I sue my attorney in small claims court for the $2500.00?

You certainly can. However, you can expect him to mount a defense (and bury you in paper).
