Legal Question in Legal Ethics in Texas
Gaining money from past employer contact infromation
LawGuru:
My son is about to leave his current employer and current industry for a new job and new industry still here in Texas. Keep in mind that out of seven sales reps, he is producing 65% of all their office's revenue, which is part of a billion dollar company. A current competitior to his current employer has offered to pay him a % of business they would gain from his contact introductions after he leaves the current employer and industry. They have offered him a signed contract to pay him a % of new business they would gain from his referring his current clients to them after he leaves his current employer, with his telling his cuurent clients that they are a good company with whom to do business. He has read his current mployee manual and does not find any non-compete or items that state that their client contacts are confidential. Is his gaining revenue from a competitor off his current employer's clients list legal? Can his current employer sue him even though he refers after he leaves their employ and leaves the industry? Thank you for your assistance!

An attorney should look into the facts before your son proceeds because this is a serious matter and may result in legal threats.
