Legal Question in Medical Malpractice in Texas
Cosmetic surgary
My mother-n-law recently had breast implants. She had to have a second surgary because the implants did not drop properly. She is now admitted into a hospital because a lung was punctured causing fluid to go into her lungs. This was a result from the second surgary. She was experiancing shortness of breath and pain so this is why she went again to the Dr. to see what was going on. As soon as the cheif surgon saw her he imedialty admitted her. Is this malpractice?

It is malpractice whenever a doctor is negligent and causes injury or damage to another by such negligence. Therefore, if a surgeon punctured a lung during a breast-implant surgery, that would no doubt constitute negligence.
