Legal Question in Medical Malpractice in Texas

Damaged Vagina

I went through Epistomy during my second childbirth 7 months back. Just 2nd day after childbirth I got infection and a hemorrhoid. The hemorrhoid was so painful that I went through surgery to remove it. I was given antibiotics to control the infection. Next 5 months I complained to doctor of continuous pain. My vagina area pained while urinating, I feel gas comming out of my vagina area, I cant have sex. After 5 months I still got pain and my tissue are not joined together in the way they supposed to. I consulted another gyno and she told us that the Epistomy is done bad. At 6th month I went through another surgery performed by first gyno to perform perineorrhaphy. Now after one month my tissues are still apart. My outer skin is not joining. I had no infection, but still lots of pain. My Gyno doctor is confused. She is telling me that she cant do anything. She now telling me to visit Gyno Oncology specialist to get the vagina area repared, as it need delicate surgery. I feel that she cheated me for 7 months to fix her problem she done to me during the child birth. She performed second surgery and still not able to fix it. Is this is medical malpractice???

To have a medical malpractice claim, you must have another gynocologist who is willing to state under oath that your doctor was "negligent." You will find that it is exceedingly difficult to find another gynocologist who is willing to do this, particularly in a case like yours. The facts of your case sound more like complications of surgery rather than negligence, in which case there is no "malpractice." To be sure, you should obtain your complete medical records and submit them to a competent malpractice attorney for review. Good luck to you.
