Re: Doctors practicing at Veterans Hospitals liability
Doctors at VA Hospitals can be held liable for medical malpractice. However, not in the same way as private doctors. VA claims must be brought under the Federal Tort Claims Act, which has special procedures and limitations. Your loved one should seek counsel with experience in handling these type of claims against the US Government. Because the clain has to go through an administrative process before a lawsuit can be filed, it's vital to act promptly to get the ball rolling and not miss any deadlines.
Re: Doctors practicing at Veterans Hospitals liability
Doctors working at veterans Hospitals are not liable for improper care but the veterans hospital can be sued under the Federal Tort Claims Act for the improper care provided by its employees. Notice must first be given to the administrative agency involved. You should consult an attorney familiar with the handling of such cases.
