Legal Question in Medical Malpractice in Texas

Hospital Suit:

we have settled w/a hospital for medical neglegence in the sum of 350,000. we live in texas but the suit is in baltimore, md. we realize we will have to pay lawyer expenses.these are my questions?

1.what % does the lawyer get?

2.are taxes withheld? (texas has no state tax.)

3.what amount can we expect to receive after all deductions?

Review the fee agreement you signed with your attorney. It will explain the money breakdown issues. Since fee agreements vary, you need to review yours. If you do not have it , call the firm, they can fax you a copy.

As for taxes, there may be some tax issues you will need to address. Speak with your attorney or an attorney in Texas about the benefits of setting up a trust. While 350K seems like a lot of money, my partner recommends at least considering a trust for your own piece of mind in the future.
