Incomplete Circumcision
My son was circumcised at 3 days old, at his 2 week visit to the pediatrician the swelling was still to much to check if it had been done correctly. Now he is almost 9 months old and has been scheduled for a phalloplasty to correct the imcomplete circumcision and multiple adhesions. Is there anything I can do about the original doctor having to pay for this additional surgery?

i am sorry you and your son are having this problem. you certainly have the right to ask the doctor to pay for the corrective surgery. my experience tells me that it is unlikely the doctor will agree to do this unless there was obvious negligence in the circumcision procedure. it is possible that what occurred was a medical complication that can occur without being the result of negligent conduct. since litigation to prove negligence would not be economical due to the changes in medical negligence law passed by the texas legislature in 2003, i would suggest that you sit down with the doctor in an nonconfrontational manner and request that he explain the complication, why it happened, whether its due to his error, and whether he would make some accommodation concerning this next procedure. i hope this helps. please email if any further questions. bill featherston
