Failing to "fully recover from surgery" does not in itself give you a medical malpractice claim. Doctors cannot make your body heal. Unless the doctor has been "negligent" in rendering medical services, the doctor would not be liable for the effects of your surgery. What about the facts of the accident itself? Were you on the job at the time? Did your employer carry workers' compensation insurance? Was there some defect in the machine, such as an improper guard (or no guard at all)?
