Legal Question in Medical Malpractice in Texas
Was told I'd be given anesthetic - only received local
I recently went in for a double wisdom tooth extraction. One was infected and turned, the other was impacted. I was told beforehand, numerous times, that I needed to be put to sleep. This is what I agreed to and paid for. I was told that if I could feel pain to raise my left hand. I ended up lucid through the whole procedure with someone holding my left hand down as I cried. It was very painful and traumatic. The Dr. would not talk to me after the procedure. I had not received the gas or the versed. I was only given the local. What can I do?

The honest answer to the question of what you can do is, "Nothing." The State of Texas has made pursuing a medical malpractice case so expensive that, unless you have catastrophic damages (you don't), the cost of the lawsuit would greatly outweigh whatever the jury would give you. There's a saying that "you hurt for free in Texas." As long as the Republicans who wrote these laws remain in office, that saying will continue to be true.
