The person at issue here stopped being awol on February 15, 2008. On that date their status changed to desertion. The military presumes that after 30 days, you intend to remain absent forever. If the person voluntarily surrenders there is a chance that the military may not charge desertion, but the individual should immediately surrender and seek legal assistance.
