Legal Question in Military Law in Texas

discharge???

i am currently in iraq, i have gotten an article 15 in the past for being late a company grade. then i was moved to a new company and i am now having problems. i am suppose to go on shift from 0900 to 1700 so someone wakes me up in the morning, just as the do for everyone else that is in my platoon. but i have not been getting woken up so i have been late. i was late today and when i got there my nco had a counciling statement for me saying that i was awol and the corrective action was for me to be chaptered out of the military. i have been flagged and they are sayin that they are going to take away my clearance. i have been counciled i think once before in this company for being late. i then told him that no one woke me up and that is why i was late and he said that he cannot wake me up to buy an alarm clock. but everyone else that stays in the same room can be woken up so that they are not late. can i be chaptered for this?

Re: discharge???

The Army does have a discharge procedure for a "pattern of misconduct."

They could remove your local access to classified material. Only Army CCF at Fort Belvoir can take your clearance. But removal from access and loss of clearance could also be reasons for separation.
