Legal Question in Military Law in Texas

Possible Discharge

My son is currently in the 2nd phase of tech school at Lackland AFB. He got sick and went to see the doctor. They took x-rays and said something was wrong with his heart. He has an appointment with a nuclear cardiologist on today. What are his options? He was in special forces training when he got sick. He is now on detail. Will he get medical discharge and if so will he receive any monetary and/or health benefits? Can he change from special forces to admin and stay active?

Re: Possible Discharge

Based on what you have written, it appears that the military may discharge your son for medical issues. If this medical condition was pre-existing there is the possibility that the military may make the argument, that your son hid this information to obtain his enlistment. Your son can always request a re-assignment. This potential re-assignment will ultimately depend upon the severity of the medical condition and your son's ability to complete the requirements for the newly assigned position. As for any monetary or health benefit, the medical discharge board will determine your son's ability to receive any or none. If my local law firm can assist you with this legal issue or any other legal matter, please contact my paralegal Tina ([email protected]) to arrange for an initial consultation.
