Legal Question in Military Law in Texas

Military pension and divorce

When my wife of 12 years and I were divorced, I was told by my attorney that she would get a relative portion of my military pension. She has since re-married, is there any recourse to avoid paying her and her new husband a big chunck of my retirement for life?

Re: Military pension and divorce

Only if the order of the court made the award of retirment conditional on her not remarrying. If the decree made no mention of any conditions, then the answer is probably no. You should consult with an attorney in Texas, if that's where the decree is from, and discuss the matter. There may be other provisions that might be of benefit to you.

I feel your pain too. When I got divorced in 1997 my ex wife got 66% of my retirement plan at that time. Thankfully I was still young enough to go back and build another plan. So, I understand why you feel as you do. That's why I think you would benefit from having the decree reviewed by a competent Texas attorney. If you're in the Houston area, I know just the person for you.

Good luck.
