Legal Question in Military Law in Texas

upgrading Under Honorable Conditions (General)

I was discharged from the Airforce 1996 with a Separation Code of JHJ and a reentry code of 2B. I was never reprimanded or involved in any illegal activities.I was received several awards and recognitions during my duty. The problems initiated after I was transferred to a base scheduled to be closed. At that time I aquired assistance from a military lawyer to help rebuttal my case. The stress and frustrations over this was too much and I chose to cease my efforts. I would like to upgrade my discharge - do I have a chance or should I seek legal assistance?

Re: upgrading Under Honorable Conditions (General)

To answer your question honestly, while it is technically possible for you to do this yourself, without the assistance of a lawyer the odds of you overlooking some legal rule or procedure, or not making the best arguments for an upgrade, make your "odds" of success minimal. While no lawyer can (ethically) guarantee any results, I have found that using a lawyer for discharge upgrades greatly improves your odds.

There are other issues that need to be considered, one of which will be the fact that you have waited so long to apply for this relief. That may or may not bar you from getting an upgrade - it will depend on a number of factual matters that are specific to you and your case.

Obviously if you hire a lawyer, there are legal fees involved and if you have a personal appearance before the Board [which is generally advisable btw] the costs for the attorney to appear. Good luck to you.
