Legal Question in Personal Injury in Texas

3 Accident no damge to my vehicle

I was recently involved in car accident. A 3rd car hit the car behind me and knocked that car into me. I was sitting still at a light. My head immedatly begin to hurt. I took the car to service they did a walkaround and saw no damange. I will need to have them look at the frame to insure that there was no damage here. The insurance company is calling harrassing me, saying that if there is no damage to the car I don't have any injuries. However, My back & neck are still hurting. I'm seeing a chiroprator for treatment. They also have a medical records release. Are they not liable for the injury charges?? I informed my insurance company when the accident happened. Should I let them know about this incident?? What should I do from here??

What you are experiencing is "tort reform" at its finest. George Bush and Rick Perry couldn't wait to foist so-called "tort reform" on the citizens of Texas. They did it by allying with the insurance industry in a massive propaganda campaign to convince the public that most people claiming injuries are frauds, and most lawsuits are frivilous. They have the majority of the public believing that, if there is no damage to your car, there can be no damage to your body. (They conveniently overlook the fact that the car was designed to take a hit, but the body was not.) The attitude you are getting from the adjuster, unfortunately, is reflective of the attitude you will get if you take your case to trial (which is, of course, where it will end up if you are unwilling to accept the pittance the insurance company will offer you on this claim). Honestly, there is little you can do because the majority of your neighbors (those who would be on your jury) are right-wing Republicans who agree with Bush and Perry and don't want you to receive any compensation for this "low-impact claim." Until we change the attitude and beliefs of the public so that jury verdicts begin reflecting fairness and not hysteria, we have little hope that victims like you will receive fair compensation.
