Legal Question in Personal Injury in Texas

3 Weeks Left until Statute of Limitations

Yes, I have three weeks left before my Auto personal injury claim will expire. The adjuster has yet to make a settlement. Is there anything I can do to get the SOL extended?

Many personal family matters have left me not to be able to handle the case before now.

Thank you

If your case is viable, then you will need to file suit within the statute of limitations and have the defendant served with process immediately. If you do not, you risk having your claim barred and you will be unable to recover. The adjuster may or may not be trying to wait you out on this. Feel free to call our office if you wish to discuss this in detail.

There is no provision for having the statute of limitations extended. You must either settle your claim or file a lawsuit against the other driver (not the insurance company) before the two-year anniversary of the accident or your case will be barred forever. You must also find and serve the defendant promptly. You are really getting over your head and you need an attorney.
