Legal Question in Personal Injury in Texas
3 yr old daughter got hurt at mcdonalds
My 3 yr old almost had the tip of her little finger slashed open by the bathroom stall door latch. we spend 6 hours at the hospital, and she had to have 6 stitches and the top part of her finger including nail removed. The bone was also chipped on the tip. The surgeon said it was definate cut. Do I have grounds for a lawsuit?

It seems that you probably have a case. One of the important elements in these types of cases is whether the defendant had notice of the hazardous condition. All such cases are based upon establishing "negligence" against the restaurant. Establishing negligence is a difficult but necessary component of your claim. A competent personal injury lawyer can assist you in meeting all the legal requirements so that you and your daughter can receive the compensation she deserves. Please call me at your earliest opportunity. In the meantime, do NOT give a recorded statement to McDonald's or their insurance carrier (and remember that each time you are speaking with them on the telephone, the conversation is probably being recorded).

Yes, you most likely do. I have a similar case with MCDonald's right now. You need to file an incident report with the store. If you have an attorney, then the attorney will use the incident report number to file a claim with the franchisee's (store owner's) insurance policy. The next step is to collect and organize all the medical bills and information and submit a demand letter. After that, your attorney can negotiate a settlement.
