Legal Question in Personal Injury in Texas

accident liability

I had an accident which involved a Lattimore Materials cement truck backing out of a new apartment construction job site. The truck caused 3 other cars to brake suddenly and skid in all directions to avoid hitting it. I was in the 4th car and was unable to avoid one of the cars since all the lanes were now occupied by vehicles that had suddenly stopped. The cement truck along with 2 of the cars left the scene, leaving me with my car totalled and the police saying that it was my liability since I was the last car and the fact that the cement truck was not hit. The intersection was under construction by the contractor and was not being controlled leaving the cement truck driver to blindly back into a busy street. (no flag man.) The intersection was not completed and that caused the cement truck to back onto the street to go to another entrance. The job site was quite large and under landscaping work causing dirt and sand to make the street slippery thus not allowing me to stop solidly. Is there any recourse from the cement company or construction company ?? Or am I left out in the cold ? HELP !!!!

Re: accident liability

Police officers, although well-meaning, are rarely experts on causation and liability in civil cases. From the facts as you have related them, it appears that you would have a case against the cement company for any property damage or personal injury you have suffered. Feel free to contact me if you decide to seek counsel.

Good Luck
